You can unsubscribe at any time by clicking the unsubscribe link in any of our emails, or by contacting us directly. Unsubscribing from marketing does not affect transactional communications such as order confirmations. We comply with the Unsolicited Electronic Messages Act 2007. All commercial electronic messages we send will include accurate sender information and a functional unsubscribe option.

How long we keep your information

We retain your personal information for as long as necessary to fulfil the purposes described in this policy, and to meet our legal and tax obligations. When personal information is no longer required, we take reasonable steps to delete or de-identify it.

Security

We take reasonable technical and organisational steps to protect your personal information from loss, unauthorised access, disclosure, or misuse. However, no data transmission over the internet can be guaranteed as fully secure. Any information you transmit to us is sent at your own risk. Once received, we will take reasonable steps to protect it. In the event of a privacy breach that we believe is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as soon as practicable, in accordance with our obligations under the Privacy Act 2020. We will take reasonable steps to contain and remediate any breach promptly.

Under the Privacy Act 2020, you have the right to:

  • Ask whether we hold personal information about you
  • Request access to that information
  • Request correction of information that is inaccurate, incomplete, or misleading

To exercise any of these rights, please contact us at the details below. We will respond within 20 working days and in accordance with the Act. We may charge a reasonable fee for providing access to information in some circumstances.

Complaints

If you believe we have breached the Privacy Act 2020 or your privacy rights, please contact us first so we can try to resolve the issue. If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner at www.privacy.org.nz.

We may update this policy from time to time. Any changes will be posted on this page with an updated date. Continued use of our website after changes are posted constitutes acceptance of the updated policy.

Factory Tour Terms and Conditions

Safety and risks

  • All visitors must follow the instructions of Happy Snacks Limited (Dr Bugs Popcorn) staff at all times.
  • The Happy Snacks Limited factory is an industrial food manufacturing site. There are potential hazards and restricted access areas throughout. Visitors must not enter any restricted areas. Parents and guardians are responsible for the safety and behaviour of children in their care while on site.
  • All visitors must remain with the group and on designated walkways at all times.
  • While we make every effort to have the factory running during your tour, we cannot guarantee what you will see. Equipment breakdowns may mean parts of the factory are not producing. If this occurs, we will talk you through the process and, where appropriate, show videos of it in operation.

Supervision of children

  • Children must be fully supervised at all times while on site.
  • The minimum adult-to-child ratio for each booking is 1 adult per 6 children.
  • Pushchairs are not permitted on the factory tour. Front packs and backpacks are preferred.

What to wear and bring

  • All visitors must wear closed-toe shoes. Jandals, sandals, and bare feet are not permitted.
  • Photos are permitted only in the shop at the beginning and end of the tour. No photos are permitted inside the factory.
  • Food and drink are not permitted inside the factory.

On arrival

  • We are only able to admit visitors up to 10 minutes before the start of their tour.
  • Please take care when crossing the car park and supervise children at all times, as trucks and forklifts may be present.

Allergies

  • Please inform your tour guide of any allergies prior to arrival.
  • An adult must take responsibility for helping children with allergies to manage their exposure throughout the tour.

Fitness

  • Visitors should be physically able to stand for approximately 45 minutes and walk up to 200 metres through the factory.
  • Limited wheelchair access is available for up to one wheelchair per tour, but must be arranged in advance.

Emergency evacuation

  • In the event of an emergency evacuation, your tour guide will direct you to the nearest designated assembly area. Please follow their instructions promptly.

Liability

  • Happy Snacks Limited reserves the right, in its sole discretion, to refuse access to any individual or group for any reason.
  • All tour participants take part at their own risk. Happy Snacks Limited disclaims, to the maximum extent permitted by law, all liability arising from or in connection with the tour, including any injury, illness, or accident occurring during the tour.
  • Happy Snacks Limited is not responsible for any loss of or damage to personal property during the tour.

General Terms and Conditions

These Terms and Conditions apply to the use of this website, including the purchase of goods. By using this website, you agree to be bound by these Terms and Conditions. If you do not accept them, you must refrain from using the website.

In these Terms and Conditions, "the seller" means Happy Snacks Limited and "the buyer" means any person purchasing from the seller.

General

  1. Where the seller accepts any order from the buyer, these Terms and Conditions (together with the seller's acceptance) constitute the entire agreement between the parties. In particular:
    • No condition in the buyer's order that is inconsistent with, qualifies, or contradicts these Terms and Conditions will have effect unless expressly accepted in writing by the seller.
    • No variation, waiver, or cancellation of an order will have effect unless accepted in writing by the seller.
  2. The seller's website and advertising constitute an invitation to treat. An order placed by the buyer comprises an offer to purchase on these Terms and Conditions, which the seller may accept by dispatching the ordered goods.

Use of site

  1. This website and all its contents are provided solely for personal, non-commercial use (other than for the purchase of goods via this site). No title, right, or interest in any materials or software is transferred to the buyer through use of this site.

Intellectual property

  1. Happy Snacks Limited's and Dr Bugs' logos, product names, and service names are the property of Happy Snacks Limited. Copyright is asserted in all content on this website and in all promotional material produced by or on behalf of the seller. Reproduction or use of any content without the seller's express written consent is prohibited.

Ordering procedure

  1. The buyer may offer to purchase goods at the price shown on this website.
    • The buyer's order must include their name, email address, payment details, and any other information specified on the website.
    • The seller may accept or reject the buyer's offer at its discretion within 5 working days and is not required to give reasons for any rejection.
    • The buyer may cancel an order prior to acceptance by following the cancellation procedure described on this website.
    • If the seller rejects an offer, neither party will have any further liability arising from that offer.
    • The seller does not guarantee the availability of goods listed on this website, but will endeavour to keep listings current.
    • Payment must be made in the manner described on the website. Prices include GST and freight unless otherwise stated.
    • Goods are offered for sale only to persons who can enter legally binding contracts.
    • All prices are in New Zealand dollars unless otherwise stated.
    • The seller reserves the right to edit or decline to send any personal message submitted with an order, including gift notes, where the content is unlawful, offensive, or otherwise objectionable.

Delivery

  1. Any delivery timeframes stated by the seller are estimates only. The seller is not liable for loss caused by any delay in delivery.
  2. Delivery will be made to the address provided by the buyer. If the buyer fails or refuses to accept delivery, the goods will be deemed delivered when left at the delivery address.

Cancellation

  1. The buyer may cancel an order up until the time it has been processed. Cancellation requests should be made by calling 03 377 1112. Once an order has been processed, cancellation will not be accepted.
  2. If a product is listed at an incorrect price due to a typographical or other error, the seller reserves the right to cancel the transaction at any point before delivery, including after the buyer's payment has been processed. If a cancellation occurs after payment, the seller will promptly issue a full refund.

Title, risk, shortages, and damaged goods

  1. Risk in goods passes to the buyer upon delivery to the buyer's delivery address.
  2. If there is a discrepancy in the buyer's order upon delivery, the buyer must notify the seller in writing within 7 days. Failure to notify within 7 days constitutes acceptance that the order was delivered correctly.
  3. The seller's liability for any shortfall or discrepancy is limited to making up that shortfall.

Warranties and liability

  1. The seller is proud of its quality and service, and will refund the purchase price if the buyer is not satisfied, provided the product is returned within 7 days of receipt. The seller will not be liable for any special, indirect, or consequential loss or damage arising from the supply of goods.
  2. The Consumer Guarantees Act 1993 will not apply where the buyer acquires goods for the purposes of a business as defined in that Act.

Copyright

  1. Copyright in this website (including text, graphics, logos, icons, sound recordings, and software) is owned or licensed by the seller. Other than as permitted by law or expressly authorised by these Terms and Conditions, the buyer must not reproduce, store, distribute, or create derivative works from any part of this website without the seller's written permission.

Force majeure

  1. The seller will not be liable for any failure to perform under these Terms and Conditions where that failure is caused by circumstances beyond the seller's reasonable control, including acts of God, fire, armed conflict, labour disputes, government intervention, supply chain disruption, or transport delays.

Governing law

  1. These Terms and Conditions are governed by the laws of New Zealand. The buyer submits to the exclusive jurisdiction of the New Zealand courts.

Amendments

  1. The seller may amend these Terms and Conditions at any time. Amendments take effect immediately upon publication on this website. Continued use of the website constitutes acceptance of the amended Terms and Conditions.

Linked websites

  1. This website may contain links to third-party websites. Those links are provided for convenience only and may not be maintained.
  2. The seller is not responsible for the content or privacy practices of any linked website.
  3. Links to third-party websites do not constitute endorsement or approval of those sites or their operators, unless expressly stated.
